Is Elder Law Only for Older People?
The term “elder law” is a rather broad, flexible descriptor for a variety of traditional areas of the law. These practice areas are typically of interest to people who are past retirement age as well as family members and others who care for them or watch out for their affairs, including settling estates after death. Practice areas making up elder law may include:
- Estate planning
- Wills, trusts and powers of attorney
- Health care directives, heath care proxies and related matters
- Health care issues, including Medicare and private health insurance challenges
- Long-term care planning
- Assisted living and nursing home contracts
- Probate and estate administration, including assistance for family members outside of Montana regarding Montana-based estates
- Probate and trust litigation such as will contests and lawsuits over trusts
Related Areas:
- Nursing home neglect litigation
- Business succession planning
- Consumer law in areas that often entrap vulnerable older people
Many of these areas of the law are also of interest to disabled adults of any age, as well as for family caregivers of the elderly and disabled. Estate planning is important to adults of any age.
Worden Thane P.C.’s attorneys help clients navigate the complex and diverse field of elder law, providing advice and representation regarding estate planning; retirement planning; planning for health care and long-term care needs; asset protection; qualifying for public benefits; and guardianship, conservatorship and other family issues. We help individuals and families prepare for and respond to the challenges of the aging process through advanced planning for their needs as they age, including planning for potential disability or illness, and by addressing more immediate needs and issues that frequently impact senior clients. We also help guide family members as they navigate these same issues.
How Can We Help You?
You may have arrived at this web page because of personal concerns for yourself, your parents or other family member. You may also realize you are facing life circumstances that cut across more than one area of law such as long-term care facility review and real estate transactions (as you or your parents prepare to sell a long-time family home and move to an over-55 community or an assisted living facility, for example) — or estate administration and taxation.
Your particular situation is no doubt unique. A personalized review of your legal needs and concerns is an important step along the way to better preparedness or a successful response to an unexpected turn of events such as a stroke or victimization through a scam targeting older people. Worden Thane P.C.’s diverse team of lawyers can advise you on one or more legal practice areas relevant to your needs.
From our Missoula law offices, we help clients throughout the region and beyond. We are eager to learn about your needs and concerns. You are welcome to call 406-721-3400 or send an email message to request a consultation with an attorney.
